Business Divorce: Thoele et al. v. Peckman et al. (Linn County, Kansas) – Represented farmer who had entered into a joint venture with another farmer to buy land and farm wheat and peas in Montana. Obtained jury verdict for client on claim of fraud for failing to provide proceeds.
Business Divorce: (Jackson County, Missouri) Represented minority shareholder in multiple cases involving a family company. The lead case was taken to a multi-week trial, resulting in an award of $4,500,000 for the client. The resulting cases then settled for an additional substantial amount to the client.
Breach of Contract: Chalmers Automotive v. SafeCage Armour Works FZ (International Chamber of Commerce) – Represented client in international arbitration against a company located in the United Arab Emirates. Tried the case before an arbitrator appointed by the International Chamber of Commerce, resulting in a six figure award in favor of our client for breach of contract.
Business Divorce: (Johnson County, Kansas) Represented business owner whose former partner attempted to seize control of the business. Case settled in favor of our client.
Fraud: (Federal Courts) Litigated numerous cases in federal courts involving federal income tax (tax shelters) and financial fraud. Tried several cases, requiring cross-examination of accountants and other financial experts.
Fraud: Performed investigation based on allegations of bribery in violation of the Foreign Corrupt Practices Act, which required travel to Switzerland.
Patent Litigation: Electric Power Group v. Alstom, S.A. (United States District Court, C.D. Cal.) – The patents related to smart technology to monitor and regulate the nation-wide power grid. The discovery phase of the case included multiple depositions in Scotland and throughout the United States. On behalf of client, obtained a summary judgment order invalidating the patents being asserted, which was upheld on appeal to the Federal Circuit.
Patent Litigation: Roche Palo Alto LLC v. Ranbaxy Laboratories (United States District Court, D.N.J.) – The patent related to a antiviral medication. Represented client in trial, which was followed by appeal to the Federal Circuit, resulting in stipulation as to the validity, enforceability and infringement of the patent at issue.
Patent Litigation: In the Matter of Certain Short-Wavelength Light Emitting Diodes, Laser Diodes and Products Containing Same, (International Trade Commission) – The patent related to light emitting diodes (LEDs). Represented respondent before the ITC, and obtained its dismissal from the investigation.

Commercial Waste: Bank of America v. Batliner Paper Stock Co. – Represented recycling company accused of “commercial waste” upon moving out of a recycling facility. Successfully obtained a unanimous jury verdict after less than an hour of jury deliberation.
Condemnation: Represent commercial property leaseholder in inverse condemnation action after city obtained portion of land through condemnation.
Commercial: Represented Tenant-in-Common (“TIC”) owners against commercial developer for fraud and violation of securities laws related to misrepresentation of conditions and tenants of a multi-million dollar commercial building.
Commercial: Represent owner in construction defect case relating to the multi-family housing built in Kansas City metro area. Construction issues relate to water infiltrating external decking resulting in wood rot, and other poor workmanship issues.
Commercial: Represented owner in construction defect case relating to condominiums built in Kansas City, MO. Construction issues relate to water infiltrating external decking resulting in wood rot, and other issues.
