Perhaps you have received a phone call about a child who was the victim of sexual assault in a military school, private school, public school, church, or other youth organization.
Sexual assault and severe bullying cases, particularly involving children, involve unique legal hurdles to prove liability. These cases often involve complex federal civil rights claims, such as Title IX and 42 U.S.C. § 1983. In some cases, Title IX applies even to an institution that presents itself as private. If the assault happened in a public school, then the plaintiff has to overcome sovereign immunity defenses. In addition, the majority of these cases get filed in or removed to federal court.
DRZ Law focuses on helping parents and children who have been victimized by sexual assault or severe bullying. We are not general personal injury attorneys. We spend our days working on and thinking about the legal issues that make these cases challenging.
Sexual assault and severe bullying cases also involve unique damages issues. By comparison to an automobile wreck, the amount of medical bills will be insignificant. Victims are psychologically traumatized, which requires a different approach to damages.
At DRZ, we do not handle every type of case that comes in the door. We also are referring attorneys for cases that are out of our depth. It gives us a sense of relief to let another attorney handle a matter that we only vaguely understand. We can give you that same sense of relief. We can help you by handling the heavy lifting on a subject matter that might be new to you.
You will not get maximum value for your client by treating a child sexual assault like a personal injury case. These cases require a different approach to establish liability and to prove damages.
